Welcome to The Smart Tiffin. These Terms and Conditions ("Terms") govern your use of our website and participation in our women's empowerment initiative. By accessing our website or applying to our program, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.

1. Definitions

  • "We," "Us," "Our" refers to The Smart Tiffin and United Gate One
  • "You," "Your" refers to the user, applicant, or partner
  • "Program" refers to The Smart Tiffin women's empowerment initiative
  • "Services" refers to all services, funding, and support provided
  • "Website" refers to smarttiffin.in and all associated domains
  • "Partner" refers to approved participants in our program

2. Eligibility Requirements

To apply for and participate in The Smart Tiffin program, you must:

  • Be a woman entrepreneur or aspiring woman entrepreneur
  • Be at least 18 years of age
  • Be a resident of India with valid identification
  • Have legal capacity to enter into binding agreements
  • Provide accurate and complete information in your application
  • Meet any additional eligibility criteria specified in the application process
  • Comply with all applicable laws and regulations

3. Application Process

3.1 Submission

By submitting an application, you certify that all information provided is true, accurate, and complete. False or misleading information may result in immediate disqualification and termination of any agreements.

3.2 Evaluation

We reserve the right to accept or reject any application at our sole discretion. Application evaluation may include background checks, verification of information, and assessment of business viability.

3.3 No Guarantee

Submission of an application does not guarantee acceptance into the program or receipt of any funding or support services.

4. Funding and Support Terms

4.1 Project Funding

Approved partners may receive project funding up to Rs 5 lakhs, subject to:

  • Execution of a formal funding agreement
  • Compliance with disbursement schedules and milestones
  • Proper documentation and reporting requirements
  • Use of funds exclusively for approved business purposes

4.2 Stall Support

Stall support up to Rs 10 lakhs may be provided for equipment, setup, and infrastructure, with ownership and terms as specified in individual partnership agreements.

4.3 Additional Support

Marketing, delivery, and operational support services are provided as-is and may be modified, suspended, or discontinued at any time.

5. Partner Obligations

As a program partner, you agree to:

  • Operate your business professionally and ethically
  • Maintain high standards of food quality, safety, and hygiene
  • Comply with all applicable food safety regulations and licensing requirements
  • Use provided funds and resources only for approved purposes
  • Provide accurate and timely financial and operational reports
  • Maintain proper accounting records
  • Allow audits and inspections as reasonably requested
  • Protect confidential and proprietary information
  • Not engage in any activity that damages our reputation
  • Comply with brand guidelines and quality standards

6. Intellectual Property

6.1 Our Property

The Smart Tiffin brand, logo, website content, and all related intellectual property are owned by us or our licensors. You may not use our trademarks, logos, or brand elements without prior written permission.

6.2 License Grant

Approved partners receive a limited, non-exclusive, non-transferable license to use specified branding materials solely in connection with their participation in the program, subject to brand guidelines.

7. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or confidential information disclosed during the partnership. This obligation survives termination of the partnership for a period of 3 years.

8. Termination

8.1 By Us

We may terminate your participation in the program immediately for:

  • Breach of these Terms or any partnership agreement
  • Fraudulent activity or misrepresentation
  • Failure to meet program standards or milestones
  • Illegal activities or violations of regulations
  • Damage to our reputation or brand

8.2 By You

You may withdraw from the program by providing 60 days' written notice. You remain liable for any outstanding obligations, including repayment of funds as specified in funding agreements.

8.3 Effect of Termination

Upon termination, you must immediately cease use of our branding, return any materials, settle outstanding accounts, and comply with any transition requirements specified in partnership agreements.

9. Liability and Disclaimers

9.1 No Warranty

Our services and website are provided "as is" without warranties of any kind, either express or implied. We do not guarantee business success, profitability, or any specific outcomes.

9.2 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or business interruption.

9.3 Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses arising from your breach of these Terms, your business operations, or your violation of any laws or third-party rights.

10. Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

10.2 Arbitration

Any disputes arising from these Terms or your participation in the program shall be resolved through binding arbitration in Maharashtra, India, in accordance with the Arbitration and Conciliation Act, 1996.

10.3 Jurisdiction

Subject to arbitration, the courts of Maharashtra, India shall have exclusive jurisdiction over any legal proceedings.

11. General Provisions

11.1 Entire Agreement

These Terms, together with any partnership agreements and our Privacy Policy, constitute the entire agreement between you and us.

11.2 Amendments

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting updated Terms on our website. Continued use after changes constitutes acceptance.

11.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

11.4 Waiver

Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

11.5 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
